Introduction
A person can apply for ‘Without Condition As To Time’ (Stamp 5 permission to remain) once they have completed 8 years (96 months) legal residency in the State. Please see eligibility criteria listed below.
Only immigration stamps in the passport or copies of expired IRP cards can be used in calculating the 96 months. When the Stamp 5 permission is granted, it is valid until the expiry of the current passport.

Submit an application
You can submit your APPLICATION FORM with the required documentation, for Immigration Permission through the dedicated Customer Service Portal. You can register for an account or log in to your existing account. Submitting applications via the Customer Service Portal ensures more efficient and speedy processing.

Please note You may also complete the Without Condition As To Time application form and forward it by post for processing. Processing an application by post may take significantly longer. Please submit your application along with the documents listed below to:

Required documents
In order to demonstrate your residence in the State the following documents are requested as part of your application:
If the documentation you submit does not adequately demonstrate your residence in the State you may be required to submit further document. This may include evidence from The Revenue Commissioners, employers or other third parties.
Processing times
Applications are dealt with in chronological order and are currently taking a minimum of 6 months to process. You must keep your current permission up to date at all times while your application is being processed.
If your application is approved
- You will receive a letter from Immigration Service Delivery granting you a permission to remain in Ireland
- Details in respect of your registration and renewal of registration will be provided with your permission letter
- You are required to register your permission by using the online registration portal.
Please note: Your permission can be revoked if we later discover that you are not eligible for this permission or if you have provided false / misleading information.
This includes, among others:
- information regarding your continued residence in the State.
- Information showing you have broken the conditions of your permission.
- Information about your character or conduct, including convictions.
- Information to show that you failed to register your permission.
